Hold Harmless & Participation Agreement
Event: Red, White & Brew: Toast 2 Troops Festival

Participation & Assumption of Risk
I understand that participation in the Toast 2 Troops Festival involves inherent risks, including but not limited to crowds, weather conditions, equipment, temporary structures, food and beverage service, transportation, and general festival activities. I voluntarily choose to participate and accept all risks associated with my participation. I am solely responsible for my booth, equipment, products, staff, volunteers, and any activities I conduct during the event.
Release of Liability
In consideration of being allowed to participate in the Toast 2 Troops Festival, I waive, release, and discharge Operation Healing Heroes Foundation (OHHF), its directors, officers, employees, volunteers, agents, sponsors, partners, affiliates, and representatives from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in the event, except to the extent caused by OHHF's gross negligence or willful misconduct.
This release includes, but is not limited to, claims involving personal injury, illness, death, property damage, theft, or loss occurring before, during, or after the event.
Indemnification
I agree to indemnify, defend, and hold harmless Operation Healing Heroes Foundation (OHHF), its directors, officers, employees, volunteers, agents, sponsors, partners, affiliates, and representatives from and against any claims, damages, liabilities, costs, or expenses, including reasonable attorney fees, arising out of or related to:
My products, services, equipment, or activities;
My booth setup, operation, or teardown;
The actions or omissions of myself, my employees, contractors, agents, or volunteers;
Injury, damage, or loss suffered by attendees, vendors, exhibitors, or property resulting from my participation; or
My failure to comply with applicable laws, regulations, permits, licenses, or event rules.
Compliance & Safety
I agree to comply with all festival policies, safety requirements, venue rules, and applicable laws. My booth, equipment, products, and activities will be maintained in a safe condition and appropriately supervised at all times.
Insurance (If Required)
Upon request, I will provide proof of general liability insurance and, if required, name Operation Healing Heroes Foundation (OHHF) and/or the event organizer as Additional Insureds.
Sponsorship Acknowledgment
I understand and acknowledge that Operation Healing Heroes Foundation's involvement with the Toast 2 Troops Festival is limited to sponsorship and community support. OHHF is not responsible for event operations, vendor management, facility management, security, attendee conduct, or the actions of the event organizer, venue, or other participants.
No Guarantees
I understand that neither the event organizer nor OHHF guarantees attendance, sales, weather conditions, publicity, profits, or any specific event outcome. I am solely responsible for safeguarding my own property, equipment, inventory, and personal belongings.
Severability
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment
By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Hold Harmless & Participation Agreement.
